Rudy Giuliani will not be part of President Trump’s defense team in the Senate trial for his second impeachment, according to a report.

The president’s personal attorney told ABC News that he will not represent Trump due to his involvement in the Jan. 6 “Save America Rally” in DC, where he called for a “trial by combat” amid the election vote certification.

“Because I gave an earlier speech [at the rally], I am a witness and therefore unable to participate in court or in the Senate chamber,” Giuliani, who had led Trump’s efforts to overturn the election results, told ABC News.

The former New York City mayor initially told the outlet that he was prepared to argue that Trump’s claims of voter fraud did not constitute incitement to violence because the debunked claims are true.

“I’m involved right now … that’s what I’m working on,” Giuliani told ABC News Chief White House Correspondent Jonathan Karl on Saturday – though Trump campaign spokesman J. Hogan Gidley tweeted early Sunday that no such decision had been made.

The House passed an article of impeachment on Wednesday charging Trump with inciting insurrection for his role in the Jan. 6 Capitol riot; Speaker Nancy Pelosi has yet to say when she will send the article to the Senate for trial.

After the DC rally, Trump-supporting rioters stormed the Capitol while members of Congress were in the midst of certifying President-elect Joe Biden’s Electoral College win.

Five people, including a Capitol Police officer, died during the siege.
