THE parents of a cancer-stricken boy who opted to treat him with herbs and marijuana oil instead of chemotherapy have lost their battle to regain custody of the child.

Childcare officials took Joshua ‘Noah’ McAdams, now four, into state protection after concerned doctors in Florida told cops he had missed his hospital treatment.

Little Noah's "natural health-loving" parents Joshua McAdams, 27, and Taylor Bland-Ball, 22, were then arrested at a home in Kentucky more than 800 miles away.

A court later ruled the little boy – who was diagnosed with lymphoblastic leukemia in April – would be handed over to his maternal grandparents.

On Monday, judge Thomas Palermo maintained that living arrangement, saying if Noah was given back to his parents he’d face “substantial risk of imminent neglect,” reports NBC News.

Remaining with his grandparents “is the only way to ensure Noah’s health, safety and well-being,” the judge said.

A lawyer for McAdams and Bland-Ball, Brooke Elvington, revealed that the couple has been left “devastated” by the decision.

“Noah belongs at home with his parents,” she said.

After pursuing a second opinion, Elvington added, the couple had voluntarily agreed to continue Noah’s chemo treatments.

She added the couple is thinking of launching an appeal.

Noah's parents have documented the toddler's cancer battle on social media – where they have railed against medical science and promoted alternative therapy.

Mum Bland-Ball regularly wrote slamming the use of chemotherapy on children.

And she insisted that her son was recovering because of vitamins and a change in diet.

She wrote on April 16, 12 days after revealing her son's cancer diagnosis: "We busted on out of that hospital – with no cancer cells left to spare.

"For those asking, we did two rounds of chemotherapy, specifically vincristine because they can get a medical court order to force you to do it anyways for a child with his diagnosis".

She added: "We also used rosemary, Vitamin B Complex, including B17, [and a] completely alkaline diet."

After her child was taken into custody she insisted her only crime is wanting "biologically sound" treatment for him.

"Our hearts our broken and all we want is for our boy to get HEALTHY BIOLOGICALLY SOUND TREATMENT," she wrote.

"No neglect here considering his levels are the best they’ve ever been and still cancer free after two weeks without chemotherapy – shocker!"
