Don’t be tardy on your car payments.

BMW Financial Services filed a lawsuit against Kroy Biermann on Monday amid his contentious divorce from Kim Zolciak.

The car company alleges that the former football player “defaulted” on the terms of their contract by “failing to make payments as agreed,” according to court documents filed in the Superior Court of Fulton County in Georgia and obtained by Page Six.

A copy of the lease submitted alongside the petition shows that Biermann, 37, signed an agreement on July 31, 2020, for a Rolls-Royce Cullinan worth about $400,100.

He traded in his Rolls-Royce Wraith, worth $205,000, at the time, and so he was expected to make monthly payments of over $5,000 throughout a 36-month period.

The total amount the father of six owed by the end of the lease term was $221,763.57.


However, payment records show that Biermann began accruing sporadic late charges in September 2020, then again in February 2021 and October 2021.

The missed payments became more frequent from January 2022 to April 2023.

According to BMW Financial Services, they asked Biermann to return the flashy car, but he allegedly “failed and refused to turn over the vehicle,” per the documents.

The “Don’t Be Tardy” alum’s attorney, Marlys Bergstrom, did not immediately return Page Six’s request for comment on why her client did not give back the car. She also did not respond to requests for comment on the lawsuit.

However, Bergstrom told TMZ on Wednesday that Zolciak, 45, is to blame for Biermann’s money troubles.

“Mr. Biermann never imagined that he would find himself in this position, having a car repossessed,” the lawyer said.

“But this is the fallout when folks find themselves spending way beyond their means. Kroy retired and no longer receives that NFL salary. … I don’t think anyone told Kim.”

Bergstrom then accused the former “Real Housewives of Atlanta” star of being “detached from reality” when it comes to finances.

“Every month Kroy has to scratch enough money together to pay the mortgage to save the home from going into foreclosure; they are getting collection notices and now lawsuits on behalf of creditors,” the attorney continued.

“Kim continues to spend money on online gambling, wine and things that are not necessities but luxuries. Well, now they have one less luxury item.”

Zolciak’s reps declined to comment on Bergstrom’s remarks or the lawsuit.

Biermann himself has previously accused his estranged wife of having a gambling addiction that “devastated” their family.

In court documents obtained by Page Six last month, the former Atlanta Falcons player requested that Zolciak undergo a psychological evaluation for her alleged “compulsions” due to her “spending substantial time and marital funds on gambling and other games of chance.”

While the former Bravolebrity has not addressed her estranged husband’s concerns, she once admitted to losing $250,000 while gambling in the Bahamas years ago.

When Zolciak and Biermann raced each other to the courthouse to file for divorce in early May, sources speculated that the estranged couple’s financial issues caused the split.

The exes reportedly owe the IRS $1.1 million in unpaid taxes, interest and penalties from 2013, 2017 and 2018, and their shared home went into foreclosure in February.

However, an insider exclusively told us in May that while money woes were a source of contention, it was not the sole reason for the divorce.

Sources also previously shut down a rumor that they broke up due to infidelity.

Despite what may have really caused the dissolution of their marriage, it is evident that there is a lot of hostility between the two.

Biermann recently claimed in court docs that his kids need to be “protected” from their “abusive” mother, while Zolciak accused the athlete of “mentally abusing” her.

The pair — who married in November 2011 — are also fighting for custody of their minor children: Kroy “KJ” Jr., 11, Kash, 10, and twins Kaia and Kane, 9.
